Holding

The bail application was rejected, and the petitioner was denied regular bail.

Summary

The petitioner, Rajesh Kumar Singh, applied for regular bail in a case involving a bank robbery amounting to Rs 60 lakh in which one person was killed. He was implicated based on a self‑inculpatory statement of a co‑accused and Rs 46 lakh of the loot was recovered from his brother. The petitioner has been in custody since 15‑04‑2021 and faces five additional criminal cases. The High Court considered the seriousness of the offences—robbery under IPC § 394, murder under IPC § 302 read with § 34, and illegal possession of arms under the Arms Act § 27—and the material recovered against him. Concluding that the circumstances did not warrant release, the Court rejected the bail application.

Issues considered

  • Whether regular bail can be granted to an accused involved in robbery, murder, and arms offences where substantial loot has been recovered and the accused is implicated by co‑accused statements.
