BAIL GRANTED

Holding

The Court granted bail to the petitioner.

Summary

The petitioner, Sachin Kumar, was arrested in connection with a case registered under Sections 137(2), 96 and 3(5) of the BNS for alleged abduction of a girl. The prosecution alleged that the petitioner had forcibly taken the victim, while the victim's statement indicated that she had voluntarily eloped with the petitioner. The petitioner had been in custody since 16 September 2025 and filed a bail application before the Patna High Court. After hearing the counsel for both parties, the Court noted the victim's voluntary elopement claim and found no compelling reason to deny bail. Consequently, the Court ordered the release of the petitioner on bail upon furnishing a bond of Rs. 10,000 with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the petitioner accused of abduction under Sections 137(2), 96 and 3(5) of the BNS given the victim's statement of voluntary elopement.
