Patna High Court

Bappi Kumar @ Pappi KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Sanjay Bhagat, was arrested in connection with a case under Sections 137 and 140(3) of the Bihar Narcotic Substances Act and has been in custody since 23 January 2025. The FIR alleges that the informant's son was summoned by co‑accused persons and that the petitioner may have been involved in the alleged threat to kill the son. The petitioner’s counsel argued that the allegations against him are vague, that he has a clean antecedent, and that the investigation is complete with a charge‑sheet already filed, leaving no risk of evidence tampering. The State opposed bail, contending that the petitioner participated in calling the informant’s son along with other accused. The court held that the prima facie case against the petitioner is based only on a general, omnibus allegation, and, given the completed investigation and prolonged custody, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 437(3) of the Cr.P.C. and Section 480(3) of the B.N.S.S. Act.

Issues considered

  • Whether the petitioner is entitled to bail despite the allegations under Sections 137 and 140(3) of the B.N.S.S. Act.
  • Whether the general and omnibus nature of the allegations and the completion of investigation justify granting bail.
