The court denied anticipatory bail to the petitioners.
Summary
The petitioners, Sunil Rajak and Sheojee Yadav, who hold the positions of Ward President and Ward Secretary respectively, sought anticipatory bail fearing arrest in a case registered under IPC sections 420, 406, 409 and 34. The prosecution’s informant, Nitesh Kumar, alleged that the petitioners were involved in irregularities related to the ‘Chief Minister Nal Jal Yojana’ and that work in Ward No. 11 of Nagar Panchayat, Jagdishpur was incomplete. The court examined the inquiry report of the Nagar Panchayat, which detailed several unfinished works such as water supply and pipe lines. Considering the allegations and the inquiry findings, the court found sufficient ground to deny the anticipatory bail. Consequently, the petition for anticipatory bail was rejected.
Issues considered
- Whether the petitioners are entitled to anticipatory bail under the circumstances alleged
- Whether the allegations of irregularities under the ‘Chief Minister Nal Jal Yojana’ justify denial of anticipatory bail
