BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a bond, sureties and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioners—Lalita Devi, Priti Kumari, and Bilash Mahto—are family members of a co‑accused, Sonu Kumar, in a case alleging kidnapping of a minor girl, forced marriage, and threats to circulate obscene videos. They were charged under Sections 87, 137, 126(2), 115(2), 352 and 351(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners contended that they were falsely implicated merely because of their relationship to the co‑accused and that the victim’s statement did not name them. The State opposed bail, arguing the seriousness of the offences. The Court, noting the petitioners’ clean antecedent and lack of direct evidence against them, ordered bail on the condition of a Rs.10,000 bond with two sureties and compliance with Section 482(2) of the B.N.S. 2023, provided they surrender within eight weeks. The order effectively granted the bail petition.

Issues considered

  • Whether the petitioners, who are family members of a co‑accused, should be granted bail despite the serious nature of the charges under the B.N.S. 2023.
