The petitioner is entitled to bail.

Summary

Krishna Kumar Singh was arrested in connection with a cyber‑fraud case (Muzaffarpur Cyber P.S. Case No. 79 of 2025) alleging the receipt of Rs 8.33 crore through a bank account of an NGO and the preparation of fraudulent Aadhar cards. The prosecution’s case relied on the statements of co‑accused and seized items such as mobiles, PAN and Aadhar cards, but no incriminating material was found on the petitioner’s possession. The petitioner contended that he was falsely implicated, had no prior criminal record, and that a similarly situated co‑accused had previously been granted bail. The State opposed the bail application, citing the seriousness of the offences under the B.N.S. and the Information Technology Act. After hearing both sides, the Court held that the petitioner was entitled to bail, directing him to furnish a bail bond of Rs 10,000 with two sureties.

Issues considered

  • Whether the petitioner is eligible for bail despite the grave nature of the offences under the B.N.S. and the IT Act.
  • Whether the evidence, primarily co‑accused statements, is sufficient to justify continued detention.
  • Whether the precedent of bail granted to a co‑accused in Cr. Misc. No. 83989 of 2025 is applicable.

the commission of money received in the account. Mahavir

Kumar @ Sonu and Guddu Kumar used to prepare Aadhar cards

by committing fraud, and they used to help him in cyber fraud.

petitioner has submitted that petitioner is innocent and has

committed no offence. He has been falsely implicated in this

seizure list, it is clear that from the possession of this petitioner

two mobiles were recovered. All the documents of the NGO

were recovered from the possession of the co-accused, namely,

                       petitioner stands on similar footing.

                                    5. The application for bail is vehemently opposed by

petitioner is directed to be enlarged on bail on furnishing bail

bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
