Holding
Anticipatory bail was denied to the petitioner.
Summary
The petitioner, Dharmendra Kumar, applied for anticipatory bail after being implicated in a FIR alleging participation in a violent robbery and murder. The FIR alleges that the accused entered an informant's house, demanded a ransom of Rs. 10,000, and, upon refusal, assaulted the informant's husband with an iron rod, causing his death. The prosecution's case is supported by a post‑mortem report linking the assault to the victim's death. The petitioner feared arrest on multiple serious charges, including murder under Section 302 IPC. The Court examined the gravity of the offences and the evidence presented, concluding that the seriousness of the allegations outweighs the grounds for anticipatory bail. Consequently, the Court rejected the petition for anticipatory bail.
Issues considered
- Whether anticipatory bail should be granted to the petitioner given the nature and seriousness of the offences alleged under the IPC.
