Patna High Court

Gaurav KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Gaurav Kumar, was charged under Sections 461 and 379 of the Indian Penal Code for alleged robbery and theft from his shop on 10 May 2024, with CCTV footage purportedly identifying him. He applied for regular bail, claiming innocence and noting that no incriminating material was recovered from his possession. He had been in custody since 26 July 2025 and the prosecution opposed the bail. The court considered the period of custody, the nature of the offences, and the lack of material evidence against the petitioner. Finding no compelling reason to deny bail, the court allowed the application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties. The petitioner was ordered to be released on bail pending trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being in custody for the offences under Sections 461 and 379 IPC.
