Bail is granted to the petitioners.
Summary
Sambat Singh and Mamta Devi, the father‑in‑law and mother‑in‑law of a deceased woman, were arrested in connection with alleged cruelty and harassment that led to the victim’s sister attempting suicide and subsequently dying. The offence is punishable under section 80 of the Bharatiya Nyaya Sanhita, 2023. The petitioners contended that they were falsely implicated, that no specific overt act was alleged against them, and that the primary accusation was against the victim’s husband, who had already surrendered. They had been in custody since 9 October 2025 and sought bail, while the State and the informant opposed the relief. Considering the facts, period of custody and surrounding circumstances, the Court allowed the bail application, directing the petitioners to furnish a bail bond of Rs 10,000 with two sureties each.
Issues considered
- Whether bail should be granted to the petitioners under section 80 of the Bharatiya Nyaya Sanhita, 2023 given the alleged cruelty, harassment and the death of the victim’s sister.
