The Court granted regular bail to the petitioner.

Summary

Manish Kumar was arrested in connection with the recovery of 16.66 kg of poppy straw (doda) from platform No.1 of Gaya Ji railway station. The prosecution alleged that he was involved in the offence punishable under Sections 8 and 20(b)(ii)(B) of the NDPS Act. The petitioner contended that no contraband was found in his possession and that he was merely standing near the toilet when the seizure was made, emphasizing his clean antecedents and that he had been in judicial custody since 2 September 2025. The State opposed the bail application. Considering the circumstances, the Court found merit in the petitioner's claim and ordered his release on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Sessions Judge-cum-Special Judge, NDPS Act, Gaya.
