The court granted regular bail to the petitioner.

Summary

Shivji Thakur, the father‑in‑law of the deceased Aarti Kumari, applied for regular bail in a case registered under Sections 80, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that Aarti Kumari, married to Krishna Thakur, was subjected to dowry cruelty and subsequently died by hanging, which the petitioner claims was a suicide caused by stress and his inability to take her to Delhi. The petitioner, a man of clean antecedent, has been in judicial custody since 3 April 2025. The State opposed the bail, but the court, after considering the circumstances and the petitioner’s background, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties. The bail order was directed to be complied with by the Sub‑Divisional Judicial Magistrate, Dhaka, Motihari.

Issues considered

  • Whether bail can be granted in a case involving alleged dowry‑related death under Sections 80, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023
  • Whether the petitioner’s clean antecedent and the circumstances of the alleged suicide justify the grant of regular bail
