Patna High Court

Robin Paswan @ Rovin PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail should be granted to the petitioners as they are not likely to be involved in the alleged offences, subject to the stipulated conditions.

Summary

The petitioners – Robin Paswan, his wife Manju Devi and Priti Kumari – applied for anticipatory bail fearing arrest in a case registered under Sections 498A, 494, 323, 504, 506 and 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. The prosecution alleged that the informant’s marriage to Amarjeet Paswan in 2021 was followed by torture and harassment for dowry demands. The petitioners contended they were innocent, unrelated to the family disputes, and were being over‑implicated; they are the father‑in‑law, mother‑in‑law and a second wife of the informant’s husband. The State opposed the bail. The court, after considering the facts, held that the petitioners were not likely to be involved in the alleged offences and granted anticipatory bail, subject to a bail‑bond of Rs 10,000 with two sureties and conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioners can be held liable for the offences alleged under the IPC and Dowry Prohibition Act
  • Whether anticipatory bail under Section 438 CrPC is appropriate in the present circumstances
  • Whether the petitioners pose a risk of influencing witnesses or tampering with evidence
