DISMISSED

Holding

The Court denied bail to the petitioner, holding that the circumstances did not warrant its grant.

Summary

The petitioner, Sajan Kumar, applied for regular bail in a case (PS Beldaur Case No. 210/2025) where he is accused of murder under Sections 103(1) and 61(2) of the B.N.S. and Section 27 of the Arms Act. The prosecution alleges that the petitioner, along with others, killed the deceased after the victim attempted to molest a girl whose marriage was being solemnized, and that the murder weapon was recovered from the petitioner’s house. The petitioner’s counsel contended that he was falsely implicated, has three prior criminal cases for which he is already on bail, and pledged cooperation with the trial. The State opposed bail, emphasizing the self‑inculpatory statements and the recovery of the weapon. The Court, considering the seriousness of the allegations and the evidentiary material, declined to grant bail and dismissed the application.

Issues considered

  • Whether bail should be granted to an accused in a murder case where the accused has made a self‑incriminating statement and the alleged murder weapon has been recovered from his residence.
