Patna High Court

Krishna KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to specified conditions.

Summary

Krishna Kumar was arrested in connection with the recovery of a stolen motorcycle and a country-made pistol, and charged under several provisions of the Bharatiya Nyaya Sanhita, 2023 and the Arms Act. He applied for regular bail, claiming innocence and false implication, and highlighted that co‑accused had already been granted bail and that he had been in judicial custody since 2 August 2025. The State opposed the bail. After considering the facts, the court ordered his release on bail upon furnishing a Rs.10,000 bond with two sureties and imposed conditions such as regular court attendance, cooperation in trial, and restrictions on tampering with evidence. The bail was granted subject to these conditions. The application was allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act given the nature of the offences.
  • Whether the circumstances, including the petitioner’s claim of false implication and the bail status of co‑accused, justify granting bail.
