Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to conditions, under Section 438 CrPC.

Summary

Petitioner Ravin Mandal applied for anticipatory bail fearing arrest in a dowry‑related complaint (Case No. 1929 of 2018) that alleged offences under IPC sections 341, 342, 323, 498A and 494. The prosecution alleged that he assaulted the victim to demand dowry, while the petitioner claimed innocence and false implication. The complainant countered that the petitioner had remarried and was residing in Sonipat. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar, the Patna High Court granted anticipatory bail under Section 438 of the CrPC, subject to a bail bond, sureties and a maintenance order in favour of the informant. The order also stipulated that the maintenance payment is pending the outcome of any separate maintenance proceedings.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the alleged offences and the Supreme Court precedent in Arnesh Kumar v. State of Bihar.
