Patna High Court

Rajesh Kumar @ Rajesh Kumar Mahto @ ChhumantarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail and the bail application is allowed.

Summary

Rajesh Kumar Mahto was arrested in a Sahayak Khazanchi case (No. 317 of 2025) under Sections 303(2), 317(4), 317(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for allegedly possessing 12 stolen mobile phones. The petitioner contended that no stolen phones were recovered from his possession, no complaint of theft had been lodged, and that a co‑accused from whom 11 phones were seized had already been granted bail. He had been in judicial custody since 17 September 2025 and had only one prior criminal case in which he was acquitted. The State opposed bail, but the Court noted the absence of incriminating material against the petitioner, the prior bail to the co‑accused, and the lengthy custody. Accordingly, the Court ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties. The application for bail was allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under Sections 303(2), 317(4), 317(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
