Patna High Court

Yogendra SahaniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a Rs.10,000 bond with two sureties.

Summary

Yogendra Sahani, husband of the deceased, was arrested in connection with a case registered under Sections 302, 304(B) and 34 of the Indian Penal Code. He contended that the deceased had committed suicide by hanging and that he was falsely implicated. Having been in custody since 2 September 2025, he applied for bail. The court examined the seriousness of the charges against the claim of innocence and the length of detention. Considering the period of custody and the petitioner's assertion of innocence, the court ordered his release on bail upon furnishing a bail bond of Rs.10,000 with two sureties of the same amount. The bail was granted subject to the satisfaction of the Chief Judicial Magistrate.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious charges of murder, dowry death and common intention under Sections 302, 304(B) and 34 IPC
  • Whether the petitioner's claim of suicide and false implication creates a reasonable doubt justifying bail
