Patna High Court

Madan SaahversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court held that pre‑arrest bail could not be granted as the allegations demonstrated a serious offence with a fatal outcome.

Summary

The petitioners, members of the Saah family, sought pre‑arrest bail after an FIR alleged that they, along with co‑accused, assaulted an informant, causing the death of the informant's father‑in‑law and injuries to others. The charges were under sections 126(2), 115(2), 109, 103(1) and 3(5) of the Bihar Negotiable Instruments Act (BNS). The High Court examined the seriousness of the alleged offences, the gravity of the injuries, and the risk of tampering with evidence. Considering the violent nature of the alleged conduct and the fatality involved, the Court found no sufficient ground to grant bail before arrest. Consequently, the petition for pre‑arrest bail was rejected.

Issues considered

  • What is the appropriate standard for granting pre‑arrest bail in cases involving serious offences such as assault leading to death under the BNS?
  • Do the facts alleged in the FIR justify denial of bail under sections 126(2), 115(2), 109, 103(1) and 3(5) of the BNS?
