The court granted bail to the petitioner on the condition of a Rs.10,000 bond with two sureties.

Summary

The petitioner, Satrudhan Kumar, sought bail in a case registered as Dhanarua P.S. Case No. 326 of 2024, alleging offences under Sections 395 and 397 of the Indian Penal Code relating to a dacoity at Utkarsh Bank. He claimed innocence, stating that the only evidence against him was a confessional statement made in a separate case and that no recovery or T.I.P. had been conducted. The petitioner highlighted that co‑accused in similar circumstances had previously been granted bail by the same court. The State opposed bail, citing the petitioner’s alleged criminal antecedents in four other cases. After hearing both sides, the court found the petitioner’s circumstances comparable to the earlier bail grants and ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under Sections 395 and 397 IPC and the existence of a confessional statement in another case
  • Whether the petitioner’s alleged criminal antecedents preclude the grant of bail
