Patna High Court

Ram Abtar Yadav @ Ramotar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to the stipulated conditions.

Summary

The petitioners, Ram Abtar Yadav and Shyam Yadav, sought anticipatory bail in connection with a 1995 case (PS No. 81) alleging offences under Sections 498A, 302, 201 and 304(B) of the IPC for assaulting an informant's sister over a cattle dispute. They contended that they were innocent co‑villagers of the main accused and had clean antecedents. The State opposed the bail, arguing the seriousness of the allegations. The Court, noting the general and omnibus nature of the accusations and the petitioners' peripheral involvement, allowed the anticipatory bail application. The bail was conditioned on a bond of Rs. 10,000 with two sureties and compliance with Section 438(2) of the CrPC and Section 482 of the BNSS, to be executed before the Sub‑Divisional Judicial Magistrate within four weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners despite the serious charges under the IPC.
  • Whether the petitioners' status as co‑villagers and lack of prior record justify bail.
