The anticipatory bail order is modified to correct the petitioner’s father’s name and the surrender period is extended by four weeks.

Summary

Petitioner Ravi Ranjan was granted anticipatory bail on 16-10-2025, but the order mistakenly recorded his father's name as “Late Rajeshwar Mehta” instead of “Late Ratneshwar Mehta”. He filed a modification application to correct this clerical error. The Court examined the application and, finding no prejudice to the State, allowed the correction. The order was amended to read the correct father's name and the period for surrender and furnishing a bail bond was extended by four weeks. The modification was granted without altering any substantive conditions of the anticipatory bail.

Issues considered

  • Whether a court may modify an anticipatory bail order to correct a clerical error in the petitioner’s name or parent’s name
  • Whether the period for surrender and furnishing of bail bond can be extended in the same modification

the learned Advocate for the petitioner and the averments made

in the modification application, the same stands allowed.
