BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioner.

Summary

The petitioner, Samarjeet Yadav, sought anticipatory bail after learning that he might be arrested in a case involving offences under Sections 103, 61, 3(5) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The FIR describes an incident where the informant’s vehicle was attacked, resulting in the death of the informant’s brother who was shot with a country-made pistol. During investigation, the petitioner’s name appeared in a co‑accused’s confessional statement and he has three prior criminal cases, two of which are of a similar nature. The court considered the seriousness of the allegations and the petitioner’s criminal antecedents. Consequently, the court rejected the petition for anticipatory bail.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the alleged offences under the B.N.S. Act and the Arms Act
  • Whether the petitioner’s prior criminal antecedents justify denial of anticipatory bail
