Decided

BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a bail bond and conditions under Section 482 of the B.N.S.S., 2023.

Summary

The petitioner, Amit Kumar, sought anticipatory bail fearing arrest in a case registered under multiple sections of the Bhartiya Nyaya Sanhita for allegedly inflicting knife injuries on Priyanshu Kumar. The FIR alleged simple injuries to the victim's back and stomach. The petitioner asserted a clean antecedent. The State opposed the bail application. The Court, considering the nature of the injury and the petitioner’s clean record, ordered that he be released on bail within eight weeks upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482 of the B.N.S.S., 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the provisions of the Bhartiya Nyaya Sanhita
  • Whether the nature of the alleged injuries and the petitioner’s antecedent justify bail
