Patna High Court

Mansur Ansari @ Md. Mansoor AnsariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail must be granted as there is no specific allegation against the petitioner and he possesses a clean antecedent.

Summary

Mansur Ansari was arrested in connection with an assault case (Basopatti P.S. Case No. 133 of 2025) under Sections 189(2), 126(2), 115(2), 103(2) and 109 of the B.N.S. He applied for bail, claiming a clean antecedent and arguing that the FIR contains only general, omnibus allegations and does not specifically charge him with assault. The prosecution opposed the bail. The High Court observed that the petitioner indeed has no prior criminal record and that the FIR does not specifically allege his participation in the assault. Consequently, the court granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation with the trial, non‑tampering with evidence, and verification of antecedents. The bail order was made without delay for antecedent verification.

Issues considered

  • Whether bail should be granted to the petitioner given the nature of the allegations and his clean antecedent
  • Whether the lack of specific charges against the petitioner in the FIR warrants bail
