Patna High Court

Mohit KumarversusThe State of Bihar

Decided

Holding

The Court granted anticipatory bail to the petitioner, subject to specified conditions.

Summary

The petitioner, Mohit Kumar, was apprehended of arrest in a case alleging that he and others, armed with weapons, fired upon a yajna, injuring the informant's son and nephew. He claimed innocence, arguing that no specific allegation of assault was made against him and that the injuries were minor. The State opposed his anticipatory bail. The Court noted that co‑accused had already been granted anticipatory bail and that the injuries were simple, and therefore granted anticipatory bail to the petitioner subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, including a bail bond and sureties, cooperation with investigation, and verification of his criminal antecedent.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC and Section 482(2) BNS, 2023 given the nature of the alleged offences.
  • Whether the simplicity of the injuries sustained by the victims warrants bail.
  • Whether the granting of anticipatory bail to co‑accused influences the decision on the petitioner’s bail.
