Patna High Court

Rana Singh @ Rama SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail may be granted to the petitioner despite the serious charges, provided strict conditions are imposed to safeguard the trial.

Summary

The petitioner, Rana Singh, is in judicial custody for murder under IPC Section 302 and offences under Sections 27 and 25(1‑b)(a) of the Arms Act. He was named in the confessional statement of co‑accused Rishu Kumar and has been in custody since April 2024. The petitioner sought bail, submitting that he will appear regularly in court and not tamper with evidence. The State opposed bail, citing the serious nature of the offences and the petitioner’s alleged involvement. Relying on earlier bail orders in similar cases, the court decided to grant bail subject to stringent conditions, including a cash bond, sureties, regular court and police appearances, and a prohibition on influencing witnesses or committing further offences.

Issues considered

  • Whether bail can be granted to an accused of murder and arms offences who is named in a co‑accused’s confessional statement.
  • Whether precedent of bail relief in similar criminal miscellaneous applications is applicable.
  • What conditions, if any, should be imposed to ensure the petitioner’s compliance with the trial process.
