Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied because the nature of the injury and the seriousness of the offences did not warrant such relief.

Summary

The petitioner, Madan Yadav, was implicated in an FIR alleging that he assaulted an informant with a weapon, causing grievous head injuries. The FIR initially charged him under several serious offences, including sections 121, 121A, 122, 126(2), 115(2), 109, 303(2), 352, 351(3) and 3(5) of the Indian Penal Code, with additional charges under sections 190, 191(2) and 191(3) later added. He applied for anticipatory bail, fearing arrest in connection with these charges. The court examined the seriousness of the alleged assault and the nature of the injuries inflicted. Considering the gravity of the offences and the serious injury caused, the court rejected the petition for anticipatory bail. The order was pronounced by Justice Prabhat Kumar Singh.
