Patna High Court

Akhilesh YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application, directing release on bail with conditions.

Summary

The petitioner, Akhilesh Yadav, was arrested in connection with a violent clash that resulted in injuries to several persons, including alleged firing of a gun that injured Lal Yadav. He faces charges under multiple sections of the Bihar Non‑Judicial (BNS) statutes and the Arms Act. The petitioner’s counsel argued that both parties were injured and that the petitioner himself suffers a serious pancreatic condition requiring surgery, as documented by jail and PMCH medical reports. The opposing counsel contended that the petitioner was the assailant who shot Lal Yadav. Considering the petitioner’s grave health issues and the principle of regular bail, the court directed that bail be granted upon furnishing a bail bond of Rs.10,000 with two sureties, subject to cooperation with the trial. Consequently, the interim application for bail was allowed.

Issues considered

  • Whether regular bail should be granted to the accused despite the seriousness of the offences under the BNS and Arms Act
  • Whether the petitioner’s serious medical condition warrants bail on humanitarian grounds
