BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Md. Hakim Akhtar, sought anticipatory bail in a case registered under Sections 302, 120(B) and 34 of the Indian Penal Code concerning the death of an informant's husband, allegedly caused by an electric shock while working at a co‑accused's house. The prosecution alleged that the petitioner was part of a conspiracy to murder, but the petitioner’s counsel argued that the FIR contains no specific allegation against him and that he was implicated merely on suspicion. The State opposed the bail, contending the seriousness of the charges. The Court examined the nature of the accusation, the lack of direct incriminating material against the petitioner, and the precedent of bail being granted to similarly situated co‑accused. Relying on Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Court allowed anticipatory bail, directing that if arrested within eight weeks, the petitioner be released on a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under the circumstances?
  • Does Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, empower the Court to grant anticipatory bail in a case involving alleged murder and conspiracy?
