Ramakant MishraversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and sureties under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Ramakant Mishra, sought bail after being implicated in a case (PS No. 264 of 2025) alleging multiple offences under the Bharatiya Nagarik Suraksha Sanhita, including assault and outraging modesty. The prosecution alleged that the petitioner and co‑accused assaulted the informant's husband and son and attempted to outrage the informant's modesty. The petitioner contended he was innocent, asserting that specific allegations of assault were directed only at other accused and that no overt act was attributed to him, and he highlighted his clean antecedent. The informant opposed bail. The court, noting the petitioner’s clean antecedent and the lack of specific incriminating acts against him, ordered bail on the condition of a Rs.10,000 bond with two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
