Patna High Court

Ritesh Ranjan @ Ritesh KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The application for anticipatory bail is dismissed.

Summary

The petitioner, Ritesh Ranjan, filed an anticipatory bail application fearing arrest in a case registered under Sections 25(1‑b)(a), 26 and 35 of the Arms Act. The police had recovered two country‑made pistols from co‑accused persons, and the co‑accused’s self‑inculpatory statement alleged that the petitioner supplied the weapons. The High Court examined whether the circumstances warranted the grant of anticipatory bail. Finding that the allegations directly implicated the petitioner in a serious offence under the Arms Act, the Court held that the case was not suitable for anticipatory bail. Consequently, the application was dismissed and the petitioner was ordered to surrender within two weeks to seek regular bail, failing which the police were directed to arrest him.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case involving alleged supply of illegal firearms under the Arms Act
  • Whether the material on record, including the co‑accused’s statement, justifies denial of anticipatory bail
