Holding

Anticipatory bail was not granted to the petitioner.

Summary

Ravi Gupta applied for anticipatory bail after learning that he may be arrested in a case (Raxaul PS Case No. 286 of 2025) involving alleged assault over a land dispute. The prosecution alleged that Gupta, along with others, committed offences under several sections of the Indian Penal Code, including assault, criminal intimidation and other serious offences. Gupta contended that he was falsely implicated and pointed to his father's earlier grant of anticipatory bail in a similar matter, while also noting his own three prior criminal antecedents. The State opposed the bail, arguing the seriousness of the charges and Gupta's criminal record. Justice Sandeep Kumar, after considering the allegations and antecedents, refused anticipatory bail, dismissed the application, and ordered Gupta to surrender within two weeks and seek regular bail, failing which the police would arrest him.
