Gorakh RamversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court denied pre‑arrest bail to the petitioner.

Summary

Gorakh Ram, a resident of Kataha village in East Champaran, was implicated in an FIR alleging that he assaulted the father of an informant with a weapon, causing grievous head injuries. The FIR charges him under sections 147, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. The petitioner applied for pre‑arrest bail, arguing that the allegations were unfounded and that he feared arrest. The court examined the seriousness of the offences, the nature of the injury, and the fact that the injury was medically certified as grievous. Considering the gravity of the charges and the potential for the petitioner to tamper with evidence or influence witnesses, the court found no sufficient ground to grant bail. Consequently, the petition for pre‑arrest bail was rejected.
