Patna High Court

Amit kumar @ Rifle Yadav @ Rifle RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Amit Kumar, was arrested on 4 December 2024 in connection with FIR No. 163 of 2024 alleging that he fired upon a victim, causing a non‑vital leg injury, and that three empty cartridges were recovered from the scene. The charges were under Sections 109 and 3(5) of the B.N.S. and Section 27 of the Arms Act. The petitioner sought bail, contending that the injury was not life‑threatening and that he was already on bail in nine other pending cases. The State opposed bail, emphasizing the direct allegation of firing, the victim’s gunshot injury, and the petitioner’s extensive criminal history. The court, after considering the facts, granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence or witnesses, and verification of criminal antecedents, and ordered that the bail bond not be delayed for verification purposes.

Issues considered

  • Whether bail should be granted to the petitioner despite the allegation of firing and the victim’s injury.
  • Whether the petitioner’s prior criminal cases and pending bail status affect the grant of bail.
