The Court granted bail to the petitioner, subject to a bond and sureties.

Summary

The petitioner, Dhiraj Singh, was arrested in connection with a dacoity at the Bank of Baroda, Ambakala Branch, alleged to have involved robbery of Rs. 26,03,000 and charges under IPC sections 395, 392 and the Arms Act. He contended that the FIR was lodged against unknown miscreants and that he was falsely implicated after a co‑accused named him, with no material recovered from his possession and no T.I.P. conducted. The petitioner highlighted that similarly situated co‑accused had been granted bail in earlier cases. The State opposed bail, citing the petitioner’s four prior criminal cases. After hearing both sides, the Court found the lack of substantive evidence and the petitioner’s cooperation conditions sufficient to grant bail, ordering a bond of Rs. 10,000 with two sureties and a requirement to appear at every trial date.

Issues considered

  • Whether bail should be granted to the petitioner under IPC sections 395, 392 and Arms Act section 27 given the nature of the alleged dacoity.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
  • Whether the absence of material evidence and a T.I.P. justifies bail.
