Holding

The Court held that bail should be granted in the present case.

Summary

Vikash Manjhi was arrested in connection with an alleged kidnapping of a minor girl for the purpose of marriage, charged under sections 87 and 96 of the Indian Penal Code. The victim, in a statement recorded under Section 183 of the BNSS, asserted that she had gone with the petitioner of her own free will and that no physical relationship existed between them. The petitioner contended that he was falsely implicated, had no prior criminal record, and had been in judicial custody since 13‑08‑2025. The State opposed the grant of regular bail. Considering the victim’s voluntary accompaniment, the absence of a physical relationship, and the petitioner’s clean antecedents, the Court inclined to enlarge bail. Consequently, the petitioner was released on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the accused in a case under sections 87 and 96 IPC where the victim claims voluntary accompaniment.
  • Whether the victim’s statement under Section 183 BNSS negates the applicability of sections 87 and 96 IPC.
