Bail was granted to the petitioner subject to the conditions laid down in Section 438(2) of the CrPC and Section 482 of the BNSS.

Summary

Amit Kumar Paswan applied for bail after learning that he might be arrested in connection with a case (Bachhwara P.S. Case No. 05 of 2023) alleging offences under Sections 366(a) and 34 of the Indian Penal Code for allegedly abducting a girl. The petitioner contended that he was falsely implicated and that the victim had voluntarily eloped with him. The informant’s counsel corroborated the petitioner’s version, supporting the claim of consensual elopement. The court examined the submissions and, finding no compelling reason to deny bail, allowed the application. Consequently, the petitioner was ordered to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to the conditions of Section 438(2) of the CrPC and Section 482 of the BNSS.
