The court allowed the petition for anticipatory bail, subject to bond and surety conditions.

Summary

The petitioner, Ravi Kumar, sought anticipatory bail fearing arrest in a case (Rafiganj P.S. Case No. 282 of 2025) involving multiple offences under the Bharatiya Nyaya Sanhita, 2023, arising from a family money dispute. The prosecution alleged that the petitioner, being the brother‑in‑law of the informant, was involved in the dispute. The petitioner asserted innocence, clean antecedents, and argued that the allegations were rooted in a domestic quarrel. The State opposed the bail, contending the seriousness of the charges. After considering the facts, the court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and comply with conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite the nature of the offences alleged under the BNSS.
  • Whether the family dispute context warrants denial of bail on grounds of potential tampering with evidence or absconding.
