DISMISSED

Holding

The court held that, given the seriousness of the alleged theft, the petitioner is not entitled to anticipatory bail.

Summary

Babul Sharma applied for anticipatory bail fearing arrest in a 2017 case (PS No. 38) concerning alleged theft of high‑tension wire, charged under Sections 379, 411, 413 and 34 of the Indian Penal Code. The prosecution alleged that Sharma and others cut and stole the wire from an electrical tower. The Patna High Court examined the nature and gravity of the alleged offence and concluded that the petitioner did not merit the privilege of anticipatory bail. Consequently, the application for anticipatory bail was dismissed. The court directed the petitioner to surrender within two weeks and seek regular bail, failing which the police were authorized to arrest him.
