The court granted regular bail to the petitioners, directing their release upon furnishing the prescribed bail bond and sureties.

Summary

The petitioners, Sonu Kumar and Salman Khan, applied for regular bail in a case registered under sections 309(6) of the BNS arising from police case No. 342 of 2025. The prosecution alleged that the informant received a call about the murder of Santosh Yadav, whose hands were tied and whose belongings were missing, and that a co‑accused’s confessional statement implicated the petitioners. The petitioners contended they were falsely implicated, had no recovered incriminating material (except two mobiles from Salman Khan, which were not the subject matter), and possessed minimal or no prior criminal antecedents, though Salman Khan had one prior conviction and earlier two under the Juvenile Justice Act. The State opposed the bail, but the court considered the lack of direct evidence, the petitioners’ clean records, and their prolonged pre‑trial detention since 17‑10‑2025. Consequently, the court ordered the release of both petitioners on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties each.

Issues considered

  • Whether regular bail should be granted to the accused under sections 309(6) of the BNS in view of the evidentiary material and their antecedents
  • Whether the confessional statement of a co‑accused suffices to justify denial of bail
