The Court granted anticipatory bail to the petitioner subject to specified conditions.

Summary

Petitioner Karu Raut sought anticipatory bail fearing arrest in a case (Ariyari P.S. Case No. 326 of 2023) involving alleged offences under Sections 307 and 34 of the IPC and Section 27 of the Arms Act. The prosecution alleged that the petitioner and others fired indiscriminately, while the petitioner contended he was not the assailant, asserting that another individual, Jugal Raut, was responsible and had already been granted regular bail. The State opposed the bail application. The Court, considering the petitioner’s claim of non‑participation and the circumstances, allowed the anticipatory bail with conditions including a bail bond, sureties, and mandatory monthly police‑station attendance. The bail is subject to cancellation upon default. The order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the applicable provisions.
  • Whether the petitioner’s claim of non‑participation in the alleged firing is sufficient to merit bail.
