The Court granted anticipatory bail to the petitioners.
Summary
The petitioners – Jai Nandan Singh, his son Pramod Kumar, grandson Prince Kumar and local resident Chotu Kumar – applied for anticipatory bail fearing arrest in a Danapur police case (No. 841 of 2025) that alleged offences under several sections of the Bharatiya Nyaya Sanhita, 2023, including assault and related crimes. The prosecution alleged that the petitioners had assaulted the victim causing simple injury, while the petitioners contended they were innocent, noting familial ties to the informant and that mutual fights had occurred between the parties. The State opposed the bail application. The Court, after considering the facts, relationships between the parties and the nature of the allegations, exercised its inherent powers under Section 482(2) of the BNSS and granted anticipatory bail. The order directed each petitioner to furnish a bail bond of Rs 10,000 with two sureties, subject to conditions prescribed by the lower court.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.
- Whether the alleged offences warrant denial of bail.
