The Court granted bail to the petitioner.
Summary
The petitioner, Dhramveer Kumar, was arrested in a cyber‑crime case (Patna Cyber P.S. Case No. 1670 of 2025) alleging offences under several sections of the B.N.S. and the Information Technology Act, including cheating through online gaming apps. The prosecution claimed that a raid on Ranvijay Kumar’s house yielded laptops and mobiles from which the petitioner allegedly confessed to cheating the public via gaming applications. The petitioner contended he was innocent, that no incriminating material was found on his person, and that the seized devices and accounts belonged to others, asserting he was merely playing the games. The State opposed bail, citing prior complaints against the gaming accounts. After hearing both sides, the High Court found insufficient linkage of the petitioner to the alleged offences and ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties. The order directed the bail to be recorded by the Judicial Magistrate First Class, Patna.
Issues considered
- Whether the petitioner is entitled to bail despite the serious cyber‑crime allegations under the B.N.S. and IT Act.
- Whether the evidence seized from the raid sufficiently links the petitioner to the alleged cheating offences.
