The court held that anticipatory bail is appropriate and granted it to the petitioners subject to bond and sureties.
Summary
The petitioners, Upendra Ravidas and Nawal Kishor Ravidas, sought anticipatory bail fearing arrest in connection with FIR No. 156 of 2025 alleging assault on an informant under several sections of the Bihar Negotiable Substances Act, 2023. The FIR described a night‑time incident where the informant’s niece was allegedly pulled away by co‑accused and the informant was assaulted, sustaining a simple injury. The petitioners argued that the parties are close relatives, the case stems from prior enmity, and a counter‑case has been filed against the informant. The State accepted that the injury was simple. Considering the familial relationship, the existence of a counter‑case, and the minor nature of the injury, the court granted anticipatory bail subject to a bond and sureties, invoking Section 482(2) of the B.N.S.S. 2023. The order directs that the bail be effective if the petitioners are arrested or surrender within four weeks.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the B.N.S.S. 2023 in view of the alleged offences.
- Whether the simple nature of the injury and the familial relationship between the parties justify the grant of anticipatory bail.
