The court granted regular bail to the petitioner.

Summary

The petitioner, Upesh Kumar, was arrested in connection with a case registered under Section 64(1) of the Bihar Narcotic Substances Act and Sections 4, 6 and 8 of the POCSO Act, alleging that he had raped a minor and caused her injury. The prosecution alleged that the offence occurred on 24-04-2025 after the petitioner gave the victim a tablet that caused bleeding. The defence argued that the victim, examined as PW‑3, denied any occurrence, stating she was suffering from fever and anemia, and that no proper statement was recorded by police. The petitioner also claimed to have no prior criminal record and had been in judicial custody since 14-05-2025. After hearing both sides, the Patna High Court, considering the lack of conclusive evidence and the victim’s denial, ordered the petitioner’s release on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties.
