The Court directed that the petitioners be released on pre‑arrest bail subject to a bond and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioners, Ajeet Ram and Bhuvan Ram, who are respectively the brother‑in‑law and father‑in‑law of a deceased woman, were implicated in a case registered under Sections 103(1), 80(2) and 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023, relating to the alleged murder of the deceased by her in‑laws over a cash demand. The prosecution alleged that the informant’s sister was killed after a marital dispute, while the petitioners contended that they were falsely implicated, had no criminal antecedents, and that the primary accusation was against the husband who was already in custody. The petitioners applied for pre‑arrest bail. The learned APP opposed the bail. The Court, after considering the nature of the allegations and the petitioners’ lack of prior record, ordered that they be released on pre‑arrest bail upon furnishing a bond of Rs.10,000 with two sureties, subject to Section 482(2) of the B.N.S., 2023.

Issues considered

  • Whether pre‑arrest bail can be granted to the petitioners under Sections 103(1), 80(2) and 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
  • Whether the nature of the allegations and the petitioners’ lack of criminal antecedents justify the grant of bail.
  • Whether Section 482(2) of the B.N.S., 2023 applies to the bail order.
