Holding

The Court held that bail should be granted to the petitioner.

Summary

Awadhesh Prajapati was arrested in connection with a case registered under sections 191(3), 117(2), 118(2), 109(1), 76, 352 and 351(2) of the Indian Penal Code for allegedly assaulting Shyam Sundar Prajapati and his wife with a stick, causing injuries. The petitioner claimed he was falsely implicated, that the incident stemmed from a land dispute with the informant (his cousin), and that he had no intention to kill, noting that most injuries were simple except for grievous injuries to the victims' hands. The State and the informant opposed bail, emphasizing the grievous nature of the injuries. The Court examined the facts, the petitioner’s clean criminal record, and the circumstances of the dispute, and concluded that bail could be granted. Accordingly, the petitioner was released on bail upon furnishing a bond of Rs 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner despite charges of assault causing grievous injury
  • Whether the petitioner had the requisite intention to commit murder
  • Whether the petitioner is a flight risk or likely to tamper with evidence
