Holding
The court held that bail could not be granted to the petitioner.
Summary
The petitioner, Nishant Kumar Sahni, was arrested for a robbery under section 392 of the Indian Penal Code, in which Rs.47,900 and a motorcycle were stolen from his shop at gunpoint. He has been in custody since 18 January 2024 and, during investigation, he and a co-accused gave self‑inculpatory statements admitting involvement. The petitioner also faces 19 other criminal cases. He applied for regular bail, arguing that he should be released pending trial. The court considered the seriousness of the offence, the admissions, and the multiple pending charges, and concluded that bail could not be justified. Consequently, the bail application was rejected.
Issues considered
- Whether the petitioner is entitled to regular bail despite self‑inculpatory statements and the seriousness of the robbery under section 392 IPC
- Whether the existence of 19 other pending criminal cases precludes the grant of bail
