The Court granted regular bail to the petitioner.
Summary
Petitioner Pramod Mehta was arrested in connection with a case registered under Sections 108 and 3(5) of the BNS for the alleged death of his daughter‑in‑law, who had committed suicide after a marital dispute. The petitioner, aged 57, had been in custody since 15 October 2025 and sought regular bail, contending that the deceased had taken her own life and that the investigation against him was complete. The State opposed the bail application. The Court examined the circumstances, including the suicide, the length of the marriage, the completion of investigation, and the petitioner’s prolonged detention, and concluded that bail was appropriate. Accordingly, the Court ordered the petitioner’s release on a bail bond of Rs. 20,000 with two sureties. The order was pronounced by Justice Shailendra Singh.
Issues considered
- What is the appropriateness of granting regular bail to the petitioner under Sections 108 and 3(5) of the BNS given the facts of the alleged suicide?
- Whether the completion of investigation and the circumstances of the deceased’s death justify bail?

that petitioner, who is 57 years old person, has been languishing

court and the deceased’s husband is already in jail and against him,
the investigation has been completed.

the bail prayer of the petitioner.

about 12 years of her marriage and as per prosecution, she
committed suicide, in my opinion, it is a fit case for grant of bail to
the petitioner. Accordingly, let the petitioner named-above be
released on bail in connection with Kutumba P.S. Case No. 46/
