Patna High Court

Raju RayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioners with conditions, finding that the circumstances did not preclude their release.

Summary

The petitioners, three brothers named Raju, Rajesh and Dinesh Ray, sought bail fearing arrest in a case (PS Marhowrah Case No. 651 of 2025) filed under Sections 115(2), 126(2), 351(2), 352, 109 and 3(5) of the Bihar Narcotic Substances Act, 2023. The prosecution alleged that the brothers assaulted an informant and his family, causing injuries, while the defence argued that the petitioners have a clean antecedent, the FIR was lodged six days after the alleged incident and the injuries were minor, suggesting the allegations are fabricated. The Additional Public Prosecutor opposed bail. The court noted the clean antecedent, the simple nature of the injuries and the delay in filing the FIR, and concluded that bail could be granted subject to strict conditions. Accordingly, the court ordered the release of the petitioners on bail of Rs 10,000 each with two sureties, imposing conditions under Section 438(2) of the CrPC regarding cooperation, presence, non‑tampering with evidence and verification of antecedents. The order directs that the bail bond not be delayed for verification purposes.

Issues considered

  • Whether the petitioners are entitled to bail in a case involving alleged assault and offences under the Bihar Narcotic Substances Act, 2023.
  • Whether the delay in filing the FIR and the nature of the injuries justify granting bail.
  • Whether the clean criminal antecedent of the petitioners warrants bail despite the prosecution’s opposition.
